By accessing or using EmbeddedDOESHire (the “Site”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you must not use the Site.

These Terms apply to all visitors, users, employers, job seekers, and any other persons accessing the Site. We reserve the right to update these Terms at any time — continued use of the Site after changes constitutes acceptance of the revised Terms.

2. Job Listings {: #sec-02}

Job listings on EmbeddedDOESHire are posted by third-party employers. The following applies to all listings:

• Listings are posted in good faith by the submitting employer.
• EmbeddedDOESHire does not verify, endorse, or guarantee the accuracy, completeness, or legitimacy of any job listing.
• We make no representations about whether any listing is current, accurate, or non-fraudulent.
• Applicants are responsible for conducting their own due diligence before applying to or accepting any position.
• EmbeddedDOESHire is not a party to any agreement between employers and applicants and has no involvement in the hiring process.

3. Employer Conduct {: #sec-03}

Employers who submit job listings to EmbeddedDOESHire agree to the following:

• Listings must be accurate and not misleading regarding the position, company, compensation, location, or requirements.
• Listings must not contain false, fraudulent, or deceptive information.
• Listings must not promote illegal activity or discriminate in violation of applicable employment laws.
• Employers must not submit spam, duplicate listings, or listings for purposes other than bona fide employment.
• Employers must not collect applicant data for purposes unrelated to the advertised position.

EmbeddedDOESHire reserves the right, in its sole discretion, to:

• Remove any job listing at any time, with or without notice, for any reason.
• Refuse service to any employer or individual.
• Suspend or ban any employer account for violations of these Terms.

We are under no obligation to review listings before they appear, but we may choose to do so.

4. User Conduct {: #sec-04}

All users of EmbeddedDOESHire agree to the following:

• You may not scrape, crawl, spider, or otherwise automatically access the Site or its content without our express written permission.
• You may not use bots, automated scripts, or any form of automated tooling to access, copy, monitor, or interact with the Site.
• You may not submit false, fraudulent, or abusive applications through the Site.
• You may not use the Site for any unlawful purpose or in violation of any applicable law or regulation.
• You may not interfere with the proper functioning of the Site, including introducing malware, overloading infrastructure, or attempting unauthorized access.

5. Intellectual Property {: #sec-05}

Site Content

The design, layout, visual interface, code, graphics, and overall presentation of EmbeddedDOESHire are the intellectual property of EmbeddedDOESHire and are protected by copyright and other applicable laws. You may not reproduce, distribute, modify, or create derivative works of the Site’s design or proprietary content without our prior written consent.

Job Listings

Job descriptions, company descriptions, and other content submitted by employers remain the intellectual property of their respective employers. EmbeddedDOESHire claims no ownership over employer-submitted content.

Trademarks

All trademarks, service marks, and logos displayed on the Site are the property of their respective owners.

6. Disclaimer of Warranties {: #sec-06}

EMBEDDEDDOESHIRE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY JOB LISTING OR OTHER CONTENT ON THE SITE.
• WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

No advice or information obtained from EmbeddedDOESHire shall create any warranty not expressly stated in these Terms.

7. Limitation of Liability {: #sec-07}

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EMBEDDEDDOESHIRE, ITS OPERATORS, AFFILIATES, OR ASSIGNS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

• YOUR USE OF, OR INABILITY TO USE, THE SITE.
• ANY JOB LISTING OR CONTENT AVAILABLE ON THE SITE.
• ANY DISPUTE BETWEEN EMPLOYERS AND APPLICANTS.
• ANY RELIANCE ON THE ACCURACY OR COMPLETENESS OF ANY LISTING.
• ANY UNAUTHORIZED ACCESS TO OR LOSS OF YOUR DATA.

THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in San Francisco County, California.

We may modify these Terms at any time. When we make changes, we will update the “Last updated” date at the top of this page. Material changes may be communicated via a notice on the Site.

Your continued use of EmbeddedDOESHire after any modifications indicates your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Site.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall continue in full force and effect.
